BY USING OUR SERVICES, YOU AGREE TO COMPLY WITH AND BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS. PLEASE REVIEW THEM CAREFULLY. IF YOU DO NOT AGREE WITH THESE TERMS, YOU SHOULD NOT USE OUR SERVICES.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Definitions, Use of Services 

1. Definitions

"Company," "We," "Our," or "Us" refer to GetSkyLight Pte. Ltd which operates these services including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

"User," "You," or "Your" refer to the individual accessing or using our website, or/and services.

“Website” or “web site” refers to the Web site bearing the URL www.getskylight.co as well as any other sites operated by us.

"Services" refers to the algorithmic trading platform and related services provided by GetSkylight Pte. Ltd.

“Terms” and/or “Agreement,” refer to these Terms of Use as set forth herein. 

"Bot" refers to the automated trading software provided by GetSkyLight Pte. Ltd..

"Broker" refers to the third-party brokerage service connected to our platform.

2. Use of Services

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or have written, parental or guardian consent, have read and understand the Terms of Use, and that you agree to be bound by these Terms of Use as set forth below. 

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). 

You must not transmit any worms or viruses or any code of a destructive nature. 

A breach or violation of any of the Terms will result in an immediate termination of your Services. 

These Terms of Use are subject to the Privacy Policy, which also governs your use of the Services. 

General Provisions

1. General conditions

We reserve the right to refuse service to anyone for any reason at any time. We may, in our sole and exclusive discretion, limit or cancel a User Account for any reason whatsoever. In the event, that we make changes to or cancel your Account, we will attempt to notify you using the email and/or billing address or phone number provided when your Account was created. However, our failure to do so will not result in any liability, including any liability for lost data, or rewards points deleted due to the Account termination.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. 

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. 

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms. 

2. Accuracy, Completeness, and Timeliness of Information

We are not responsible if information made available via the Services is not accurate, complete, or current. You acknowledge that the Services are provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information. You acknowledge further that any reliance on the Services is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

3. Access

Though we try to make the Services available twenty-four (24) hours a day, seven (7) days a week, except for planned downtime for maintenance, we do not warrant that the Services will be at all times available. 

We do not warrant that your computer, tablet, smartphone, or hardware will be able to access and/or support the Services.

4. Prohibited Uses

In addition to the other restrictions on use set forth herein, you are prohibited from using the web site or its content: (a) for any unlawful purpose; (b) to solicit Users to perform or participate in any unlawful acts or to engage in acts that are unrelated to the purpose(s) of the Services; (c) to violate any international or governmental regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; (k) to impersonate any person or entity; (l) forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted through the Services; (m) “frame” or “mirror” any part of the Services, without our prior written authorization or use meta tags or code or other devices containing any reference to us in order to direct any person to any other service or Web site for any purpose; (n) modify, adapt, translate, reverse engineer, decipher, decompile, separate, or otherwise disassemble any portion of the Services or any software used on or for the Services; or (o) to interfere with or circumvent the security features of the Services. We reserve the right to terminate your use of the Services for violating any of the prohibited uses or for any other reason in our sole and exclusive decision. 

5. Disclaimer of Warranties; Limitation of Liability

We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

Your use of any information or materials on the website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services, or information available through the website meet your specific requirements.

In no case shall GetSkyLight Pte. Ltd., our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

We are not certified financial advisors nor do we provide financial advice via our Services. Rather, the information made available via the Services is intended as an assisting tool. User agrees and acknowledges that, due to the volatile and unpredictable nature of the industry in which the Services operate, success and profit are not guaranteed.

GetSkyLight Pte. Ltd. is not a broker and does not hold nor accept trading funds. In order to trade the markets, you must open a trading account with a broker.

You are urged to carefully read and consider the following before utilizing any or all of our services: (a) No aspect of the Site is intended to provide, or should be construed as providing, any investment, tax, or other financial-related advice of any kind. You should not consider any content on the Site to be a substitute for professional financial advice. While individual participants may offer investment advice or opinions and/or effect a transaction which may be subsequently copied by another trader, such advice, opinions, or trades amount to nothing more than exchanges between persons who may be anonymous or unidentifiable or simply the execution of a trade by such traders. GetSkyLight Pte. Ltd. does not provide investment advice directly, indirectly, implicitly, or in any manner whatsoever by making such information and/or features available to you. You should use any information gathered from here and/or utilize the GetSkyLight Pte. Ltd. features only as a starting point for your own independent research. (b) The Site, Services, and GetSkyLight Pte. Ltd. features are provided by GetSkyLight Pte. Ltd. solely for informational purposes. GetSkyLight Pte. Ltd. and/or any on its behalf, including its affiliates and their employees and agents are not investment or financial advisers.

6. Indemnification

You agree to indemnify, defend, and hold harmless GetSkyLight Pte. Ltd. and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Users

1. User conducts

The Services may contain the ability to communicate with other Users on one or more platforms, comments sections, discussion forums, Web sites, landing pages, social media outlets, sales channels, and/or other interactive features, such as our Telegram group (“Interactive Areas,”) in which Users may communicate. By participating in Interactive Areas, you agree and acknowledge the following community guidelines. Violating these rules may lead to suspension of your account or your permanent exclusion from the Services. If you are permanently excluded from the Services, your Account will be terminated, and you will not be allowed to use our Services again. 

Enforcement of these rules is entirely at the discretion of GetSkyLight Pte. Ltd., and where we think the actions of users may affect the enjoyment or safety of others in our community, GetSkyLight Pte. Ltd., reserves the right to take necessary action, including but not limited to reporting you to law enforcement. For the avoidance of doubt, any content or activity featuring, encouraging, offering, or soliciting illegal activity is prohibited. We can and will notify law enforcement of any illegal activity found taking place through our Services.

We reserve the right to regularly update these guidelines without notice based on the evolution of the GetSkyLight Pte. Ltd. community and the services we provide. 

By becoming a user of GetSkyLight Pte. Ltd. you agree that you:

Shall not upload, distribute, or otherwise publish any libelous, defamatory, obscene, pornographic, abusive, or otherwise illegal material;

      • Shall not threaten or verbally abuse another User, use defamatory language, or deliberately disrupt discussions with repetitive messages, meaningless messages, or “spam”;

      • Shall not use language that abuses or discriminates, on the basis of race, religion, nationality, gender, sexual preference, age, region, disability, etc. Hate speech of any kind is grounds for immediate and permanent suspension of access to all or part of the Services, without recourse; 

      • Shall not personally attack another User. Personal attacks are a direct violation of these Terms of Use and are grounds for immediate and permanent suspension of access to all or part of the Services, without recourse;

      • Shall not distribute or otherwise publish any material containing any solicitation of funds, advertising, or solicitation for goods or services;

      • Shall not upload, post, or otherwise transmit any content that violates any law or engage in activity that would constitute a criminal offense or give rise to, a civil liability; 

      • Shall not post unauthorized commercial communications (such as spam); 

      • Shall not upload, post, or otherwise transmit any content that advocates or provides instruction on illegal activity, or discuss illegal activities with the intent to commit them;

      • Shall not upload, post, or otherwise transmit content that does not generally pertain to the designated topic or theme of the Services;

      • Shall not impersonate any person or entity, including, but not limited to, any of our employees, or falsely state or otherwise misrepresent your affiliation with any person or entity;

      • Shall not engage in unlawful multi-level marketing, such as a pyramid scheme;

      • Shall not upload, post, or otherwise transmit any content, software, or other materials, which contain a virus or other harmful or disruptive component;

      • Shall not interfere with or disrupt the Services or the servers or networks connected to the same, or disobey any requirements, procedures, policies, or regulations of networks connected to the Services;

      • Shall not share or otherwise distribute or make public personal information of other Users and/or individuals or entities;

      • Shall not facilitate or encourage any violations of these Terms of Use or our policies.

2. Account Registration

In order to access our Services, you will be required to create an account. By creating this account, you agree to the following:

      • You may only maintain a single account;

      • You must provide accurate and complete information and keep your account information up-to-date;

      • You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. 

      • You may never use another user’s account without permission;

      • You are solely responsible for the activity that occurs on your account

      • You must notify us immediately of any breach of security or unauthorized use of your account;

      • You will be liable for any use made of your account or password and the losses due to such unauthorized use. We will not be liable for your losses caused by any unauthorized use of your account.

GetSkyLight Pte. Ltd has the right, in its sole discretion, to cancel your subscription or suspend your access to the Site.

Fees

1. Subscription Fees

Users wishing to subscribe to our Services must pay a Subscription Fee in the amount set forth on at the time of purchase. We may increase these Subscription Fees from time to time, in our sole and exclusive discretion, where such changes shall take effect upon the next Billing Cycle (as defined in Section 4.2.) All Subscription Fees are expressed in U.S. Dollars ($USD.)

2. Automatic Billing; Form of Payment

Except for in the event of a trial premium subscription, all Subscription Fees as set forth herein shall be prepaid, in full as per the selected billing cycle (which may be a month, 6 months or year, the “Billing Cycle,”) on the first (1st) day of the Billing Cycle, where the first (1st) day of the first (1st) Billing Cycle shall be the date upon which User registers for a premium subscription. Users shall be billed on the same day thereafter at the beginning of each Billing Cycle.

Payment shall be made automatically via our payment processor, Stripe, by automatic debit of the major credit or debit card provided by User upon Account registration or as later updated by User. 

3. Subscriptions. 

Subscriptions can be used as soon as the payment is done; any purchased subscription will be active for a subscription period. When you subscribe, your account will be billed on the first day of the Billing Cycle until you cancel the auto-renew option, or if the system fails to charge your account.

4. Refund Policy.  

Due to the electronic nature of the services that we provide, in no event other than material breach or of these Terms by us or a defect in the Services, shall a refund be granted, in whole or in part, for any reason or no reason whatsoever, including but not limited to User’s cancellation prior the end of the Billing Cycle and/or User’s failure to utilize the Services.

Third-Party 

1. Use of Third-Party Tools

We may provide you with access to third-party tools over which we neither monitor nor have any control or input.

You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations, or conditions of any kind and, without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the Services is entirely at your own risk and discretion, and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

2. Third-Party Links

Certain content, products, and services available via our Services may include materials from third parties.

Third-party links may direct you to third-party Web sites and/or services that are not affiliated with us, you are free to choose any Broker that supports Metatrader 4 or Metatrader 5. We are not responsible for examining or evaluating the content or accuracy, and we do not warrant and will not have any liability or responsibility for any third-party materials or Web sites and/or services or for any other materials, products, or services of third parties.

3. Additionals 

PAST PERFORMANCE RESULTS ARE NOT NECESSARILY INDICATIVE OF FUTURE RESULTS. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN. THERE ARE NUMEROUS OTHER FACTORS RELATED TO THE MARKETS IN GENERAL OR TO THE IMPLEMENTATION OF ANY SPECIFIC TRADING PROGRAM, WHICH CANNOT BE FULLY ACCOUNTED FOR BY PAST PERFORMANCE RESULTS. PROSPECTIVE CLIENTS SHOULD BE PARTICULARLY WARY OF PLACING UNDUE RELIANCE ON PAST PERFORMANCE RESULTS AND SHOULD NOT BASE THEIR DECISION ON INVESTING IN ANY TRADING PROGRAM SOLELY ON THE PAST PERFORMANCE PRESENTED. ADDITIONALLY, IN MAKING AN INVESTMENT DECISION, PROSPECTIVE CLIENTS MUST ALSO RELY ON THEIR OWN EXAMINATION OF THE PERSON OR ENTITY MAKING THE TRADING DECISIONS AND THE TERMS OF THE ADVISORY AGREEMENT INCLUDING THE MERITS AND RISKS INVOLVED.
